VA, DIRT LOVERS POLICY AND
USER AGREEMENT

Va, Dirt Lovers (www.vadirtlovers.com) aka. (VDL) is a free service of Va, Dirt Lovers ("VDL") provided to people over the Internet.

This is a legal agreement ("Agreement") between you and Va, Dirt Lovers. In return for your usage of the VDL service, which includes but is not limited to by viewing or transmitting any data to or from VDL, or creating a message board on Va, Dirt Lovers or using services directly related to VDL and other services from VDL, you and VDL agree to all the terms and conditions herein.

You may not "Spam" or in any way broadcast or perform mass postings to our forums, or users. Additionally, Va, Dirt Lovers does not allow the addition of Va, Dirt Lovers site, forums or any users of Va, Dirt Lovers names, email addresses, or other information to any software which may be used for spamming, mass-posting, or the broadcast of messages to our site. These activities use extra resources on our system, degrade the quality of service for our members, necessitate our labor, increases our support load, and can disturb members and visitors, and decreases on the quality of out system and or business's public image. Any attempts at any such activities are considered a abuse of or attack on our system and company and parties performing such activities or participating in providing services or software which contribute to such activities may be held accountable and subject to legal action. In addition, such activities can and are hereby considered a Denial of Service (DoS) attack and are subject to criminal treatment. We do not take this lightly. Va, Dirt Lovers is not to be used for spamming, mass-postings, or the broadcasting of messages by any method without the written consent of Va, Dirt Lovers.

You will not stalk users of our system, nor will you post, email, or otherwise transmit any data which is illegal, harassing, threatening, abusive, or obscene to out system nor any user of our system. Also included as such an activity is the display of any private information of an individual, company, or other organization without permission of that individual, company, or organization. Such activities are not only considered an abuse of our system, our company, image, increase on our personal labor, and can cause other damages. Notice is hereby given that any party contributing or otherwise participating in such activity is subject to legal action from any related parties, including Va, Dirt Lovers.

Va, Dirt Lovers reserves the right to suspend or terminate without notice our access to Va, Dirt Lovers and/or message board for any reason and at VDL's sole discretion. The right to delete a message board/ chat or refuse service to any individual includes but not limited to the reasons specified in this agreement.

You understand that VDL is able to be provided to you because VDL, and some of Va, Dirt Lovers revenues result from VDL selling advertising space on the VDL web site, pay it for; this includes, but is not limited to, pages set up by VDL as well as individual message boards/chat. As a message board/chat creator, you agree to follow the guidelines and instructions provided in this agreement, in message board/chat set up, and in any other administration areas of the system.

Va, Dirt Lovers refers to creators and administrators of message boards/chat/forums as "Forum owners" and it is hereby understood that this term is used solely to express the creator (of the message board/chat) as having management rights over the message board only as described in this document.

By your use of Va, Dirt Lovers you agree to the following:

· You are solely responsible for the information or content you display or make available ("post") on Va, Dirt Lovers or transmit in any
way to other VDL users, including those not covered by this agreement. VDL reserves the right, but has no obligation, to monitor disputes between you and
other members/visitors and users of Va, Dirt Lovers.

· You will use Va, Dirt Lovers in a manner following any and all applicable laws and regulations and will not post or transmit any data on Va, Dirt Lovers or to an VDL members, visitors, or employees, any illegal material or material that infringes upon another parties rights. Furthermore, post must not include any data other than plain text or HTML code and, as the administrator of the message board you create, you are responsible for any post made to the message board you create which contain unacceptable data.

· Your forum and the posts in our forum may not contain material of sexually-oriented, adult, pro-racist, pro-hate-related, or harassing nature, post with profanity, nor may you post wares or software in any forum including but not limited to raw, encoded, or encrypted data.

· Forums cannot be created, used, or continued with the primary or dominant purpose or usage of "bashing".

· You will not post, transmit, reproduce or distribute in any way any copyrighted material, trademarks, or other proprietary information without obtaining prior consent from the owner of such proprietary rights or in any way violate applicable local, state, federal, or international law, nor will you impersonate any person including but not limited to users of VDL, public figures, individuals related to the activities of VDL, including the staff, volunteers, or other parties, nor will you falsely represent yourself as being affiliated with any such parties, individuals, or entities.

· Additionally, you will not engage in unsolicited advertising to other members, visitors, or any other users of VDL to buy or sell any products or services.

· You may not copy text/HTML/source code from any VDL message board/chat, including your own, to any other location including but not limited to other services or web sites on the Internet.

· You may not include advertisements, banners, or images on your message board/chat for purpose of advertising anything other than your own parts, equipment, or supplies if your message board/chat is dedicated to your own specific parts, equipment or supplies. You may not include advertisements, banners, or images on Va, Dirt Lovers web site for Commercial/business purposes, or use VDL to sell products and services for commercial/business.

· If you use any Va, Dirt Lovers message board/chat in a frame the banner advertisement at the top of the message board/chat must be completely visible without having to scroll when the board loads on a 600x480 pixel screen and the other frames must not contain advertisement of any kind.

Va, Dirt Lovers may, at its discretion, provide features and option to allow you to attempt to limit access to your message board/Chat to/from selected users by various methods. Some of these methods may be but are not limited to: password protection, read access based n IP/hostname, post access based on IP/hostname, or profanity filtering. Although VDL may provide these services as a convenience to you, with or without their usage or availability, you provide these services as a convenience to you, with or without their usage or availability, you agree that VDL cannot be held responsible for stopping any particular individual from posting or reading messages on board, nor are there any guarantees to the availability or proper functioning of such features. Additionally, VDL may not be able to prevent specific types of material from being submitted to your board, including image links or URL's.

Va, Dirt Lovers cannot guarantee the proper functioning or availability of any VDL options or services, including the possibility of a complete unavailability of the service. You will not hold us liable for any loss or damages resulting from the use or malfunction of the message board/chat service.

Va, Dirt Lovers provides VDL message board/chat service on an "as is" basis and Va, Dirt Lovers grants no warranties neither expressed, implied, nor statutory with regards to its services nor with communication to VDL or its representatives or employees, affiliate companies. Specifically, VDL disclaims any warranties of merchantability, fitness for a particular purpose, or nor-infringement. Va, Dirt Lovers does not warrant that VDL services will be available, nor that they will be error-free or secure, nor that it will meet your requirements. Additionally, VDL makes no claims that the message board/chat will be virus free, or that defects or errors will be corrected.

You agree to defend, indemnify, and hold harmless Va, Dirt Lovers, its officers, directors, employees, agents, or third parties in the case of any loss or damages, either direct, incidental, or consequential (including but not limited to damages in loss of data, loss of programs, or cost or procurement of substitutes services interruptions), even if these damages arise out of the use or inability to use Va, Dirt Lovers services even if Va, Dirt Lovers or its agents, representatives, or employees have been advised or notified of the possibility or occurrence of such damages.

You understand that Va, Dirt Lovers cannot be held liable for any acts or omissions of other members/visitors or other users including unauthorized users, members, or hackers.

The content of message boards/chats, including, but not limited to, any opinions, advice, statements, or offers made available on Va, Dirt Lovers are those their respective authors and not of VDL and should not necessarily be relied upon. The authors are solely responsible for such content and VDL does not guarantee nor is VDL responsible for the accuracy, usefulness, or completeness of any information on the service nor does VDL endorse any such content. Under no circumstances will Va, Dirt Lovers be responsible for any loss or damage resulting from anyone's reliance on content or neither information made available via VDL nor information transmitted to VDL members, visitors, or other users.

Additionally, Va, Dirt Lovers reserves the right, but has no obligation, to monitor the materials posted or otherwise made available on VDL or pertaining to VDL, including but not limited to posts made on VDL and private messages between users of VDL. It is also understood that users may supply to VDL content provided to them by other users of VDL. It is understood that the monitoring of all such information is necessary for multiple reasons including but not limited to the need for VDL to be aware of the content available via VDL, the information transmitted as a result of content available via Va, Dirt Lovers, maintaining the quality of service, and monitoring its service for bugs or errors in VDL's software or content.

Furthermore, Va, Dirt Lovers reserves the right, but has no obligation, to remove any material it wishes at any point in time, specifically but not limited to material that violates, or is alleged to violate, the law or this agreement. Notwithstanding this right of VDL, you and other users of VDL remain solely responsible for the content of the material you post in VDL, information or make available through VDL, r our private email messages.

*NOTE: It is possible that Va, Dirt Lovers members or users, including unauthorized users or hackers, may post, transmit, or make available offensive or obscene materials on or via Va, Dirt Lovers and you may be exposed to such materials. Additionally, it is possible for your personal information to be accessed by users and used to harass or injure you. Va, Dirt Lovers is not responsible for the use of an personal information that you may choose to disclose on or to Va, Dirt Lovers or via its services. Please carefully choose the information and type of information you make available via Va, Dirt Lovers or release to others.

Va, Dirt Lovers owns and retains all rights to information it makes available via VDL including but not limited to proprietary post made by VDL employees, any and all proprietary graphics and data otherwise made available, and any and all copyrighted material, trademarks and all other proprietary information of Va, Dirt Lovers and its licensors. Additionally, VDL members or users ma post copyrighted information and trademarks whether or not they are clearly identified or indicated as such, and except for that information, which is in the public domain or of which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information.

By posting information or content to any public area of Va, Dirt Lovers you are at risk of this information being copied or used in a manner you do not wish. It is your responsibility to consider the type of information you wish to make available and, if your rights are violated by another VDL member or user, you are solely responsible for handling the matter and you understand the Va, Dirt Lovers will not be involved with such issues.

Certain jurisdictions limit the applicability of warranty disclaimers and imitations of liability, so the above disclaimers of warranty and limitations of liability may not apply to you.

This Agreement is entered into in Virginia. You agree that Virginia State law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the federal and state courts in Virginia. This Agreement, accepted upon signing up for Va, Dirt Lovers' services contains the entire agreement between you and Va, Dirt Lovers regarding the use of the Service.

This Agreement may be modified or amended at any time by Va, Dirt Lovers, but will always be available for viewing on the Va, Dirt Lovers website. This Agreement may not be modified or amended by you without official authorization by Va, Dirt Lovers and the subsequent written approval from Va, Dirt Lovers of the final agreement. Unless otherwise explicitly stated, the Terms will survive termination of your membership to Va, Dirt Lovers. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

Should you at any time transfer your consideration in this contract to another entity, including but not limited to any other individual, company, corporation or organization, the new entity must agree to all terms of the most recent revision of this agreement, which will be available on the Va, Dirt Lovers website for the duration of Va, Dirt Lover’s services.
